These terms ("Agreement") are between you ("you," "your," or "user(s)") and Find Felicity LLC, a Washington State limited liability company ("Find Felicity"). "Software" means the Felicity application, website, and related services made available by Find Felicity. Throughout this Agreement, the words "Find Felicity," "us," "we," and "our" refer to Find Felicity, as is appropriate in the context of the use of the words.
By clicking "I Agree," creating an account, accessing, or using the Software you agree to be bound by this Agreement and the Privacy Policy (https://www.findfelicity.com/privacy.html). We may amend this Agreement or the Privacy Policy from time to time and may notify you when we do so, and you agree to be bound by the amended Agreement and/or Privacy Policy. If you do not agree to the Agreement or the Privacy Policy or any amendments thereof, please cease using our Software immediately.
All users are required to provide truthful and accurate information when registering for our Software. We reserve the right to verify all user credentials and to reject any users. In order to use our Software:
You are solely responsible for the content you post, share, or transmit through the Software, including your profile, your Personal Truth, messages, and posts in community areas. The Find Felicity Community Guidelines, available within the Software and at https://www.findfelicity.com/community_guidelines.html, are incorporated into this Agreement by reference, and a violation of the Community Guidelines is a breach of this Agreement.
Find Felicity has no tolerance for objectionable content or abusive users. We may remove content and suspend or terminate the account of any user who posts objectionable content or engages in abusive behavior, at our sole discretion, with or without notice. You may report content or conduct from within the Software, and reported content is reviewed and acted on in accordance with the Community Guidelines.
This Acceptable Use Policy applies to everyone who uses the Software, in every section, public or private, including profiles, Personal Truth, messages, the Coffee House, The Commons, events, and any other feature. It works together with the Community Guidelines, and a violation of this Acceptable Use Policy is a breach of this Agreement.
Felicity is for adults only. You must be at least 18 years old to use the Software.
You may not use the Software to:
Enforcement. Everything you write and every photo you upload is screened automatically when you save it, and can be reviewed by a Felicity moderator. We may remove content, limit features, or suspend or permanently terminate any account that violates this Acceptable Use Policy, with or without notice. Some violations end an account the first time, including, but not limited to, human trafficking, sexual exploitation, any sexual content involving a minor, threats of violence, and sexual extortion. We may preserve information related to a violation and report it to law enforcement, as described in Protocols for Law Enforcement below.
Suspected fake accounts. Accounts suspected of being fake, or of misrepresenting who the member is, may be suspended without prior notice. A suspended member is told how to appeal when they try to sign in. Appeals are made by email to support@findfelicity.com, and we may ask you to verify your identity before an account is considered for reinstatement.
Reporting. You can report any profile, message, or post from within the Software, or by email to support@findfelicity.com. If you believe someone is in immediate danger, contact 911 or your local emergency services first.
Felicity is free to join. A Free membership costs nothing and has no time limit.
Felicity Plus is an optional paid membership with additional features. Plus prices, in U.S. dollars:
Every Plus feature is free for all members through December 31, 2026. Paid Plus memberships begin January 1, 2027. You will not be charged for Plus unless you choose to purchase it.
ID Reviewed is an optional identity review, offered for a one-time fee of $8. ID Reviewed shows that a member completed an identity review. It is not a background check.
Plus memberships can be purchased through Apple's App Store, Google Play, or our website, depending on where you subscribe. Purchases made through the App Store or Google Play are billed by Apple or Google and are also subject to their terms. Purchases on our website are processed by our payment processor. Find Felicity does not receive or store your full card number. The App Store and Google Play may show prices in your local currency, and applicable taxes may be added at checkout.
Automatic renewal. Plus memberships renew automatically at the end of each billing period for the same length of time, and your payment method is charged at the current price unless you cancel before the renewal date. We may change our prices from time to time. A price change will not affect a billing period you have already paid for, and we will notify you before a new price applies to your membership.
Any cost for a Felicity event is shown on the event listing. Products sold in The Felicity Mercantile (mercantile.findfelicity.com) are priced and sold on that store, under its own store policies.
You can cancel a Plus membership at any time. Canceling stops future renewals, and you keep your Plus features until the end of the billing period you already paid for. How you cancel depends on where you purchased Plus:
Deleting your account or the app does not cancel an App Store or Google Play subscription. Please cancel through Apple or Google as well.
Except as described in this section or required by law, payments are non-refundable, and we do not give refunds or credits for partial billing periods or unused features.
Find Felicity grants you a limited, revocable, non-exclusive, non-transferable license to use the Software solely for your personal use for as long as this Agreement remains in effect, until terminated by you or by Find Felicity. Except as expressly permitted under this Agreement or by applicable law, You shall not: (i) reverse engineer, decompile, disassemble or separate for use on more than one computer, place for distribution, sale, or resale as individual creations by You, the Software and/or its constituent parts; (ii) alter, merge, adapt or translate the Software, or decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human-perceivable form; (iii) rent, lease, or sub-license the Software; or (iv) unless otherwise expressly agreed in a separate written agreement between You and Find Felicity (a) use, or permit the use of the Software on a timeshare or service bureau basis, or (b) host, on a subscription basis or otherwise, the Software to permit a third party to use Your account on the Software for any reason; or (c) create derivative works based upon the Software.
You retain all ownership and intellectual property rights in and to your data you input on the Software. Find Felicity or its licensors retain all ownership and intellectual property rights to the Software. Find Felicity retains all ownership and intellectual property rights to anything developed and delivered under the Agreement. All rights not explicitly granted are reserved for Find Felicity. If you breach this Agreement, including the User Content and Conduct section and the Community Guidelines incorporated by reference, we may revoke your license or your access to use our Software at our discretion. Additionally, we may revoke your license or restrict your access to our Software if we believe that your actions may harm us, our business interests, or any of our users. Failure by us to revoke your license or restrict access does not act as a waiver of your conduct or a waiver of our right to revoke at a subsequent point in time for any of your prior or new actions constituting breach.
You agree not to cause, or aid in, the disruption, destruction, manipulation, removal, disabling, or impairment of any portion of our Software, including the de-indexing or de-caching of any portion of our Software from a third party's website, such as by requesting its removal from a search engine. User shall, at its own expense, comply with all laws, rules and regulations, and assume all liabilities and obligations imposed by such laws, rules and regulations, with respect to the user's use of the Software.
Find Felicity implements administrative, physical, and technical safeguards for protection of the security, confidentiality, and integrity of your information during processing of user content. Those safeguards used are based on industry practices.
Our Privacy Policy explains what information we collect, how we use and share it, how we protect it, and the rights you have, including rights under the Washington My Health My Data Act. The Privacy Policy is part of this Agreement and is available at https://www.findfelicity.com/privacy.html.
This section explains how government and law enforcement agencies can request information about Felicity members. Members of the public should not use this process. If you are in danger, call 911. To report a member, use the report tools within the Software.
Email requests to support@findfelicity.com with "Law Enforcement Request" in the subject line, or mail them to the address under Contact Information below. We accept requests only from official government email addresses or on official letterhead. Please include:
We disclose non-public member information only in response to valid legal process issued under applicable law, such as a subpoena, court order, or search warrant, except in the emergencies described below. We may decline or ask for clarification of any request that is overly broad, unclear, or not legally valid. Requests from outside the United States must be made through a Mutual Legal Assistance Treaty (MLAT) or another procedure recognized under U.S. law.
When we receive an official preservation request, we will preserve available account records for 90 days while the requesting agency obtains legal process. We can only preserve and provide information we still have.
If you believe a member is involved in an emergency involving a risk of death or serious physical injury, email support@findfelicity.com with "Emergency Disclosure Request" in the subject line. Describe the emergency and the information you need. We review emergency requests as quickly as possible and may disclose information without legal process when we believe in good faith that the law allows it.
As required by federal law, when we learn of apparent child sexual abuse material, child sex trafficking, or the enticement of a minor on the Software, we report it to the CyberTipline of the National Center for Missing & Exploited Children (NCMEC).
We may notify a member of a request for their information, unless we are prohibited from doing so by law or court order, or notice could put someone at risk.
We may report to law enforcement, without a request, any activity we believe in good faith to be unlawful or a threat to someone's safety, including violations of the Acceptable Use Policy.
THE SOFTWARE IS PROVIDED ON AN "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, NEITHER FIND FELICITY, NOR ANY OF OUR EMPLOYEES, MANAGERS, OFFICERS, ASSIGNS OR AGENTS MAKE ANY REPRESENTATIONS OR WARRANTIES OR ENDORSEMENTS OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, AS TO: (1) THE SOFTWARE; (2) ANY INFORMATION PROVIDED VIA THE SOFTWARE; OR (3) SECURITY ASSOCIATED WITH THE TRANSMISSION OF INFORMATION TO FIND FELICITY, OR VIA THE SOFTWARE. IN ADDITION, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, CUSTOM, TRADE, QUIET ENJOYMENT, SATISFACTORY QUALITY, SYSTEM INTEGRATION AND FREEDOM FROM COMPUTER VIRUS. FIND FELICITY DOES NOT REPRESENT OR WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SOFTWARE OR THE SERVER THAT MAKES THE SOFTWARE AVAILABLE IS FREE FROM ANY HARMFUL COMPONENTS. YOU ACKNOWLEDGE THAT FIND FELICITY DOES NOT CONTROL THE TRANSFER OF DATA OVER COMMUNICATIONS FACILITIES, INCLUDING THE INTERNET, AND THAT THE SERVICE MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF SUCH COMMUNICATIONS FACILITIES. FIND FELICITY IS NOT RESPONSIBLE FOR ANY DELAYS, DELIVERY FAILURES, OR OTHER DAMAGE RESULTING FROM SUCH PROBLEMS. FIND FELICITY DOES NOT WARRANT THAT YOUR USE OF THE SOFTWARE IS LAWFUL IN ANY PARTICULAR JURISDICTION, AND FIND FELICITY SPECIFICALLY DISCLAIMS ANY SUCH WARRANTIES.
IN NO EVENT SHALL FIND FELICITY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FIND FELICITY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM (1) YOUR USE OR INABILITY TO USE THE SOFTWARE OR ANY ERRORS, MISTAKES, OR INACCURACIES FOUND WITHIN THE SOFTWARE, (2) ANY PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SOFTWARE, (3) ANY INTERRUPTION, MISINFORMATION, INCOMPLETE INFORMATION, OR CESSATION OF TRANSMISSION TO OR FROM OUR SOFTWARE TO YOU, (4) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SOFTWARE VIA A THIRD PARTY, (5) ANY FAILURES OR DISRUPTIONS WHETHER INTENTIONAL OR UNINTENTIONAL, OR (6) ANY ACTION TAKEN IN CONNECTION WITH ANY THIRD PARTY COPYRIGHT OR OTHER INTELLECTUAL PROPERTY OWNERS.
This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of the State of Washington. The parties irrevocably agree that the courts of Clark County, Washington shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims). The failure of Find Felicity to enforce any right or provision in this Agreement shall not constitute a waiver of that or any future right or provision unless acknowledged and agreed to by Find Felicity in writing. This Agreement constitutes the entire agreement between the parties and supersedes all previous agreements, understandings and arrangements between them in respect of its subject matter, whether in writing or oral.
